However, the Platform states clearly that ‘any measures or changes related to abortion within the health system can only be determined at the national or local level according to the national legislative process’ (Beijing Platform for Action, 1995, para 107(k)).

In 2004, 17 people including 7 women, who it was alleged had illegal abortions, were acquitted of all charges (Feminist Majority Foundation, 2004b). Thus, while the right to abortion might not be eroded in the West in the dramatic way it is being eroded in Eastern Europe, it is by no means guaranteed. The examples we have used have shown that in Malta and Ireland there is no right, or a very restricted right to abortion, while in countries where abortion has long been regarded as a reproductive right groups continue to lobby to overturn this right.
